Enforcement actions

The enforcement tools available to us vary across the different sectors we regulate. They can include notices of non-compliance, issuing directions, disciplinary action, fines, or criminal prosecution. Depending on the sector they operate in, registered and licenced gambling providers and individuals may also face censure, suspension or cancellation.

When breaches are detected, our regulatory response is proportionate to the risks posed and harm caused by the gambling provider’s failure to comply with their obligations. We consider their conduct, including their level of cooperation, and whether they have proactively taken steps to rectify or remedy the issue.

We take a zero-tolerance approach to enforcement when we detect deliberate or opportunistic contraventions by operators.

Disciplinary action is regarding issues of non-compliance that require suspension or the disqualification of a licence.

Disciplinary action can be taken by the Commission or by a staff delegate. The action we take depends on the severity of the breach, the risk of harm to the community, and the operator's compliance history. We work closely with other agencies and law enforcement agencies.

Disciplinary action is focused on altering the behaviour for the protection of the public through a more tailored response specific to the licensee.

Crown Melbourne - Disciplinary action - Self-exclusion

On 14 October 2024, the Victorian Gambling and Casino Control Commission fined Crown Melbourne Ltd $2 million dollars for allowing 242 people who have self-excluded to gamble at Crown’s Melbourne casino, between October 2023 and May 2024. People can apply upon their own volition to be self-excluded, to prevent experiencing further gambling harm. It is an offence for Crown to allow excluded people, including self-excluded people, to gamble.
