Upcoming hearings

The table below lists all pending gaming machine applications. Hearings are held at the Victorian Gambling and Casino Control Commission (VGCCC) hearing room located at 49 Elizabeth Street, Richmond. We provide written notice to all parties, detailing the date and location of the hearing.

The Victorian Gambling and Casino Control Commission (Commission) may conduct hearings and inquiries in public or private. Unless confidentiality considerations apply, we will generally hold public hearings.

The Commission may hold:

  • a hearing about an application for a new gaming venue, or an increase in gaming machines
  • an inquiry to determine disciplinary action against licence holders for alleged breaches of licence conditions, the law or responsible gambling codes of conduct
  • an appeal of a casino exclusion order or a decision made by a VGCCC delegate.

Our independent Commissioners make decisions on gambling matters, including determining applications for new gaming venues or more gaming machines, disciplinary actions and considering appeals of decisions made by VGCCC delegates.

Hearings

The Commission may conduct meetings and inquiries in public or private. Unless confidentiality considerations apply, we will generally hold public hearings.

Decisions

We prepare and publish decisions and reasons on certain gaming applications and disciplinary action proceedings.

It is standard practice to publish a copy of our decisions and reasons.

Appeals

You may request the Commission reviews a VGCCC decision. Or you can appeal a Commission decision through the courts on a question of law.

Disciplinary actions

Submissions

If you want to make a comment or submission about an application, you can contact the Council where the premises are located. Your submission should directly relate to the application and address how it will impact on the well-being of your local community.

Attending a public hearing

Hearings may be conducted:

  • in person in the VGCCC hearing room
  • by videoconference (Zoom), with an option for teleconference.

Assistance with access to VGCCC hearings

Participants for matters scheduled for hearing in person at the VGCCC hearing room may request assistance with access to the hearing including translation services, physical assistance and video conference because of:

  • Communication issues
  • Health issues
  • Physical mobility
  • Wellbeing, safety and security
  • Location
  • Other access issues

Members of the public may request access to observe a hearing by videoconference rather than attend in person.

If you have any special requirements to help you participate in an in-person hearing, please contact the VGCCC Secretariat prior to the hearing date.

Should you wish to participate via videoconference, please contact the VGCCC Secretariat and discuss your options with them.

How hearings work

Electronic gaming machine applications

The hearing will be conducted by members of the Commission and presided over by either the Chairperson or a Deputy Chairperson.

At the hearing, each party will have the opportunity to explain their view and put forward any relevant evidence or submissions. This may include calling witnesses.

After considering the application, the Commission may either grant the application (with or without conditions) or refuse it.

Disciplinary action proceedings

A Commissioner will consider materials and information provided by all parties and decide if an inquiry will be held.

Any inquiry will be presided over by either the Chairperson or a Deputy Chairperson of the Commission.

Where facts are in dispute, the parties can put forward their view and call any relevant witnesses.

Casino exclusion order appeal

If you receive a casino exclusion order (including a self-exclusion order), you may appeal the order to the Commission.

On receiving a request, the Commission may decide your appeal based on written information, or hold an appeal hearing.

You do not have to attend an appeal hearing.

Your appeal will be held in private and is decided by one or more Commissioners.

Requesting a private inquiry

A party to, or witness before, an inquiry may request a private inquiry.

The Commission may decide to hold a private inquiry if:

  • confidential or personal information will be disclosed
  • it is in the interests of justice.

Counsel Assisting

The Commission will generally appoint a suitably qualified lawyer to be Counsel Assisting a Commission inquiry.

Their role is to help the Commission conduct the hearing, including questioning of witnesses and eliciting information necessary for the Commission to consider a matter. They also provide the Commission with legal advice concerning its powers, duties, functions and obligations.
