Upcoming hearings

The table below lists all pending gaming machine applications. Hearings are held at the Victorian Gambling and Casino Control Commission (VGCCC) hearing room located at 49 Elizabeth Street, Richmond. We provide written notice to all parties, detailing the date and location of the hearing.

The Victorian Gambling and Casino Control Commission (Commission) may conduct inquiries – also known as hearings – in public or private. This is subject to certain legal requirements. The Commission may conduct hearings to determine matters including:

  • applications for a new gaming venue or an increase in the number of electronic gaming machines (EGMs)
  • disciplinary action against licence holders including for breaches of licence conditions, the law or responsible gambling codes of conduct
  • an appeal against a decision of a delegate.

Hearings

The Commission may conduct its hearings in public or private depending on the type of matter and whether confidentiality or public interest considerations apply.

Appeals

You may request the Commission reviews certain decisions of a VGCCC delegate.

You may also appeal an exclusion order issued by the casino operator (including a self-exclusion order), to the Commission.

The Commission may determine a casino exclusion order appeal in private based on written information.

Attending a public hearing

Hearings may be conducted:

  • in person in the VGCCC hearing room
  • by videoconference.

If you would like to attend a hearing, please email secretariat@vgccc.vic.gov.au(opens in a new window) at least one business day before the hearing.

How hearings work

EGM applications

The hearing will be conducted by members of the Commission and presided over by either the Chairperson or a Deputy Chairperson.

At the hearing, the applicant and the relevant council will have the opportunity to explain their view and put forward any relevant evidence or submissions. This may include calling witnesses.

After considering the application, the Commission may either grant the application (with or without conditions) or refuse it.

EGM application submissions

If you want to make a submission about an EGM application, you can contact the council where the premises are located or us directly. Your submission should directly relate to the application specifically and how it will impact on the well-being of your local community.

Assistance with access to VGCCC hearings

Participants in matters scheduled for hearing in person at the VGCCC may request assistance with access to the hearing. This could include translation services, physical assistance and video conference because of:

  • communication issues
  • health issues
  • physical mobility
  • wellbeing, safety and security
  • location
  • other access issues

Members of the public may request access to observe a hearing by videoconference rather than attend in person.

If you have any special requirements to help you participate in a hearing, please contact the VGCCC Secretariat prior to the hearing date.

Inquiries determined in private

The Commission may decide to determine a matter in private if there are special circumstances that require it. For example, if:

  • confidential or personal information will be disclosed; or
  • it is in the interests of justice.

Disciplinary action proceedings

The Commission may decide to hold an inquiry in private to hear submissions regarding grounds for disciplinary action. The Commission will consider materials and information provided by all parties when deciding if an inquiry should be held.

An inquiry will be presided over by either the Chairperson or a Deputy Chairperson of the Commission.

Counsel Assisting

The Commission will generally appoint a suitably qualified lawyer as Counsel Assisting the Commission to determine certain matters.

Their role is to help the Commission conduct the hearing, including questioning of witnesses and eliciting information necessary for the Commission to consider a matter. They also provide the Commission with legal advice concerning its powers, duties, functions and obligations.
