Venue operators and manufacturers of poker machines should be familiar with the requirements under the Gambling Regulation Act 2003 prohibiting the publishing of gaming machine advertising.
Gaming machine advertising means any form of advertising that contains any information, term, expression, symbol or other thing associated with gaming machines (e.g. pokies, slot machines, gaming room, gaming, gaming floor).
Section 3.5.34AA prohibits a venue operator, or a person acting on their behalf, from publishing or allowing someone else to publish any gaming machine advertising outside the gaming machine area (the area within the green line) of an approved venue.
Section 3.5.34 extends the prohibition to other persons, including poker machine manufacturers.
The above requirements generally prohibit the public advertising of gaming machines on website and/or social media sites such as Facebook and Instagram.
The penalty for not complying with gaming machine advertising requirements exceeds $22,000.
